OUR AIM AND OBJECTIVES

The Association VITA UNICA (Unique Life Trust) was established October 21, 2011 in India and stems from the free will of the citizens under the light of unresolved problems-faced which are bad or poorly-managed by the state and the market. It consists of a group of people united by a desire to devote part of their free time helping out others, especially the less fortunate, in particular disabled children and orphans.

That is why volunteering is part of the “third sector” together with other organizations that do not respond to the logic of profit or public law.

The Volunteering has a long history, linked with the idea that targeted work can act as the glue between different cultures and people, even when they have lived moments of conflict, even violence.

It is an informative experience that has among its aims to enrich the participants for several reasons:

• it is a concrete work of civic engagement;

• it opens the mind and encourages dialogue;

• allows you to discover the features of other cultures;

• can be the basis of new friends;

• it is a good opportunity to practice languages.

The countries where practiced volunteering range from countries with advanced economies to those are poorer and are generally aimed at anyone, without distinction of any kind. In the world there are hundreds of voluntary organizations linked to each other that organize or promote thousands of initiatives annually. As a result we have now established a legal operation in Italy too, where many volunteers collaborate in order to provide subsidies for children.

To be precise we aim to work towards the realization of the fullness of life here on earth for those who are most in need. Not as CHARITY, but as DUTY of every born brethren towards ones neighbor.

We explain how and why: In the long history of human life more than 2000 years, we have encountered this question at least once in our life time: Why does God allow some people to be born into poverty and some to be born with a ‘Silver Spoon’? This is a really great question which is not easy to answer.

The problem lies not in the fact that there is no answer, but the answer is complex and perhaps not specific as we would like it to be. The last thing to say about this inequality and suffering, is that God is not unaware of it, but has done something decisive of it. So, in other words, there is inequality in this world, because it is a shattered world, caused by the rebellion of mankind against God’s rule. Yet God restrains his opinion in front of our rebellion allowing even to suffering and inequality in the world, to give us the opportunity to recognize our rebellion and return to him. This is the reason why there is inequality and suffering in the world.

Poverty is always a choice. Undoubtedly poverty is a choice. No one is born with riches and neither die with it. The only thing that matters is the will power. Today we have people who were poor in the past but now rich. So any poor living anywhere in the world always has a choice to get rich. Just dream and chase it. Consequently there can never be ever-lasting child poverty and its effects.

Evident truths. We hold these truths to be self-evident, that all men are created equal; that they are endowed by their Creator with certain unalienable Rights, such as Life, Liberty and the pursuit of Happiness.

So volunteers VITA UNICA try in a humble way, to help those who are in most need to realize the fullness of life. We do not promise extraordinary life to anyone but try to fulfill the basic needs required for those who seek help. We invite volunteers and donors to join us if you are touched by our pursuit.

ABOUT THE TRUST

 

I. The name of the Trust shall be “VITA UNICA (UNIQUE LIFE TRUST)” 

II. The objects of the Trust shall be wholly Educational, Charitable and Welfare Oriented for the benefit of public without any intention of earning Profit and without any distinction of Caste, Creed, Sex, Community or Religion and the Objects shall be carried out only in India and shall consist of the following :

1) To promote Awareness Generation Programmes for rural people, Poor and Needy Persons by organizing Meetings, Conferences, Seminars and Programmes aimed at Human development in Education, Health, Awareness Generation and to lead the Indian brethren to the life in fullness by promoting the Social, Educational, Economical well being of the people of India especially the under privileged and downtrodden people.

2) To establish and run YOGA & Meditation Centres at different locations for the purpose of educating the people about the importance of YOGA and Meditation for the benefit of the Public and create Awareness about YOGA & Meditation, Diet (Natural and Traditional), Nutrition, Necessity for physical exercises, Healthy life, Necessity for proper medicines and Treatments, etc.

3) To establish and run Old Age Centres for taking care for elders, orphanages for needy people and home for working women.

4) To provide, establish and run Vocational Training Programmes for economically and socially backward unemployed youth in getting Technical skill for Advancement.

5) To work for empowerment of Poor and Needy persons through various welfare schemes and programmes, Rural Development Programmes, Housing Programmes for poor, Adult Education, Creche Centres for children, Awareness Generation Programmes, Self-help Groups, Agricultural Development Programmes, Aged Homes, Short stay Homes for women, Orphanages for Children, Socio-Economic Programmes for youth, Child employment eradication, Welfare Programmes for poor and needy persons and to undertake and run Social Welfare Projects and Programmes by getting support and guidance from various Government Agencies, Welfare Boards and Non-Governmental Organisations.

6) To establish and run Educational Institutions, Colleges, Schools, Professional Colleges and Technical Institutions in the areas of Medical, Engineering, Nursing, Theraphy and various required lines for the welfare of the students of India.

7) To establish and run Hospitals, Mobile Centers, Health Camps and Allied Health Care Programmes for poor persons with a view to help people especially women and children.

8) To create Awareness in the minds of the people by running Awareness Programmes, Camps, Propaganda through Journals, Pamphlets and all other means of communication.

9) To donate liberally towards Teaching Aids / Scholarships for financially backward students / schools and deserving students for pursuing education, vocational training, skill development and encouragement by Prizes, Medals, Awards for excellence in studies, Sports and Research and by distribution of Books and Note Books to poor students.

10) To bring out, encourage, develop and grant donations for the inventive and research faculties of the pupils and teachers and to afford opportunity for research work in Art, Science and Industrial undertakings.

11) To approach various Government Departments, State and Central Social Welfare Boards, Ministries and Donors, both Indian and Foreign for the implementation of the Trust’s activities in India for the benefit of poor and needy sections of our country and preservation of natural resources by carrying out the suitable Welfare Programmes for the poor and needy.

12) To acquire and hold land and properties and construct buildings for creating infrastructures required for the purpose of carrying out the objectives of the Trust.

13) To approach Ministry of Home Affairs, New Delhi for the grant of FCRA Exemption Number to mobilize foreign contributions for the educational, charitable and welfare programmes of the Trust.

14) To do all acts, deeds, things that are incidental and conducive to the attainment of the objects of the Trust.

15) All the above activities are purely charitable and would be carried out in the territory of India only and no activity shall be carried out outside India and the Trust shall not take up any activity with the object of earning a profit.

V) POWERS OF MANAGING TRUSTEE :

The Managing Trustee is the responsible person to do all activities on behalf of the Trust. The Managing Trustee can appoint one of the Trustees for the post of Secretary or Treasurer. The Managing Trustee or such other nominated Trustee is empowered:

1. To sign in all documents, appoint or dismiss any staff, to endorse bills/vouchers, to sell, buy or purchase movable/immovable properties, to create assets and convene meetings.

2. To take on lease/rent/purchase lands, buildings, fixed assets and vehicles to fulfil the objectives.

3. To invest and keep invested the Trust funds and to alter, vary or transpose Trust’s Investments from time to time in his absolute discretion as he thinks fit. The funds of the Trust will, however, be invested on the modes prescribed in section 11 and 13 of the Income-tax Act, 1961.

4. To acquire any immovable property from Trust funds and disposing them off as and when considered necessary subject to the approval of the Director of Income-tax (Exemptions).

5. To implement all schemes, alter or modify schemes and related procedures for carrying out the objectives of the Trust and for the management of the affairs thereof for the furtherance of the objects of the Trust and otherwise for giving effect to the object of the Trust or to add to vary, alter or modify any one or more or all of the objects of this Trust provided the object of the Trust is not affected in any way or the Trustees do not derive any personal benefit from such action.

6. To obtain any Loan secured on the Assets of the Trust for the purpose of utilising the same towards the Objects of the Trust from Banks, Financial Institutions and other Hire Purchase, Leasing and Finance Companies on behalf of the Trust by passing proper Resolution in the Meeting of Board of Trustees and the borrowing powers shall be exercised by the MANAGING TRUSTEE.

VI) The Founder may from time to time frame rules for conduct of the administration of the Trust and regulating the meeting of the Trustees. In the absence of such regulations all matters will be decided by majority of the Trustees present and voting.

VII) The Maximum and Minimum number of Trustees shall be 10 and 3 respectively.

VIII) The Trustees will be entitled and be at liberty to accept gifts or any Voluntary Contributions or Donations in Cash or Kind from any persons including the individual trustees and/or otherwise collect donations to augment income to the Trust Fund and use such moneys for the objects of the Trust. It shall always be open to the Trustees in their absolute discretion to accept or refuse any such donations, gifts and/or contributions.

IX) The Trust shall be managed by the Managing Trustee, with the co-operation and the help of TRUSTEES, who shall have the powers of day-to-day management and administration of the Trust. The Trustees shall not be paid any share of profit or advantage from the funds of the Trust.

X) There shall be atleast 1 Board Meeting in a year and the quorum in the meeting of the Board of Trustees shall be 3 or satisfying minimum 1/3rd of the existing Trustees.

XI) Without prejudice to the generality or the powers already mentioned, the Managing Trustee or his nominated Trustee for the post of Secretary shall have the additional powers namely:

1) To employ Clerks and other employees, Agents, Bankers, Doctors, Lawyers, Auditors, Accountants and others at such remuneration as he may think fit.

2) To withdraw any power or revoke any appointment of any employee or attorneys.

GENERAL:

1) Bank Account/Accounts/Deposits shall be opened in the name of the Trust and such account/accounts shall be operated individually by the Managing Trustee, on behalf of the Trust and in his absence, he has the right to appoint one of the Trustees or any other persons to such post and the person so appointed shall operate the Bank Accounts by passing a Resolution in the meeting of the Board of Trustees.

2) The Trustees shall have the power to sell, convert or otherwise release any Trust properties where it is deemed expedient or necessary for carrying out the objects of the Trust. The funds of the Trust will be solely utilised towards the objects and no portion of it will be used for payment to Trustees by way of Profit. The Managing Trustee is authorised to execute all the documents on behalf of the Trust.

3) It is declared and understood that it shall be lawful for Trustees to resolve and frame the rules for the conduct and management of the Trust or Trust Funds or for the carrying out the objects of the Trust and such resolutions and rules framed, amended, altered or substituted shall have the same force as they have been incorporated in the original TRUST hereby created as long as the rules so framed are not repugnant to the objects of the Trust. Any such amendment shall be made only after obtaining the approval of the Director of Income-tax (Exemptions).

4) The Trustees shall invest the Trust Funds as per Sec. 13(i) (d) and Sec.11(5) of the Income-tax Act, 1961 as amended from time to time in approved investments only and the Managing Trustee is authorised to sign the necessary documents as already mentioned.

5) The TRUSTEE shall keep proper books of accounts of the Income and Expenditure of the Trust and maintain day-to-day transactions of the Trust which shall be closed every year on 31st March and the accounts shall be audited by a Chartered Accountant and approved in the Trust Board Meeting.

6) The Trust is registered as an IRREVOCABLE Public Charitable Trust under the Indian Trust Act as amended upto date. In case of dissolution or winding up of the Trust or in case of any dispute, the assets would be transferred to Institutions having similar objects and enjoying exemption under Section 11 and 80-G of the Income-tax Act, 1961 and the funds of the Trust shall not be divided or distributed to the Trustees in any manner or to persons defined in Sec.13(10)(C) of the Income-tax Act, 1961.

7) The Trustees shall at all times stand indemnified in respect of any bonafide act that may have been done in respect of all matters relating to the Trust.

8) The Trust shall not spend more than 5% of the Income of the Trust for any religious purposes or given to religious Institutions.

9) Alienation of any immovable property of the Trust shall be done only with the approval of the Director of Income-tax (Exemptions), Chennai and the Secretary Trustee is authorised to take all necessary steps in this regard.

10) Any of the claims of the Trust Deed can be altered or amended by executing an Amendment Deed.
